Manila, Philippines – How are workers paid when a regular holiday also falls on a special non-working holiday?

President Rodrigo Duterte signed Proclamation No. 556, declaring August 21, 2018 as a regular holiday throughout the Philippines in observance of “Eid’l Adha” or Feast of Sacrifice.  Another holiday, Ninoy Aquino Day, is also commemorated on that day, which is a special non-working holiday.

If two holidays are celebrated in one day, how much do a worker get if he does not work, or renders his work, or if he works on an overtime hours.

Payment of Wages for August 21 Holidays

The Department of Labor and Employment (DOLE) releases the guidelines of payment of wages on August 21:

2019 Long Weekends and Breaks in the Philippines #WalangPasok

  1. If the employee did not work, he shall be paid 100% of his salary for that day, subject to certain conditions under the implementing rules and regulations [(Daily rate + Cost-of-Living Adjustment (COLA)) x 100%].
  2. If he renders his work, he shall be paid an additional 30% of his daily rate of 200%. It shall be computed as follows: [(Daily rate + COLA) x 200%] + [30% (Daily rate x 200%)]
  3. If he works overtime (work done in excess of eight hours), he shall be paid an additional 30% of his hourly rate computed as follows: (Hourly rate of the basic daily wage x 200% x 130% x 130% x number of hours worked).
  4. If he works on the said day which is also his rest day, he shall be paid an additional 50% of his daily rate on the first eight hours of work computed as follows: [(Daily rate + COLA) x 200%] + [50%(Daily rate x 200%)].
  5. If he works in excess of eight hours (overtime) on said day, which is also his rest day, he shall be paid additional 30% of his hourly rate on said day (Hourly rate of the basic daily wage x 200% x 150% x 130% x number of hours worked).
